Customer hereby agrees to lease from Henigin's Small Engine Repairs the Equipment written on the signed invoice. Customer agrees to pay the Rental fees in the amount(s) and the time frame agreed upon. The Agreement applies to all Rentals.
The Equipment shall remain at all times with the customer. Customer shall not intern lease or give permission to anyone other than a family member or an employee if being rented by a company.
Customer shall keep the Equipment in good condition and working order, and use the Equipment for its intended purpose.Customer is responsible for all regular maintenance of the equipment (when rented on consecutive days). The customer shall not change or alter the Equipment with out written permission.
This Agreement shall continue in full force and effect until the equipment is returned by the customer to Henigin's. The equipment when returned shall be in working and clean condition
During the term of this agreement, the customer shall be solely responsible for any loss or damage to the Equipment. The customer shall also be solely liable for all claims, including but not limited to Workers Compensation or claims for personal injury or damage to property, arising directly or indirectly,out of use of the Equipment. The customer agrees and shall bear the risk of loss for theft, damage, destruction, or other injury to the Equipment in any event that may occur. No such loss or damage shall impair any obligation of the customer to pay the amount that is due upon the return of the Equpiment. If the Equipment is damaged, customer agrees to pay for damages.
If the Equipment is not repairable,the customer agrees to pay market value of the equipment plus shipping fees of the new or used Equipment being replaced.
If the customer defaults in any performance required for a period of 10 (ten) days, (a) this Agreement maybe terminated by Henigin's, (b) Henigin's shall have the right to enter the customers premises and remove the Equipment without notice, (c) Henigin's shall be entitled to persue any other remedies available by law and in equity.
Failure to strickly enforce the terms of the Agreement shall not preclude a party from asserting a subsequent or waiver of the Agreement requiring strict performmance with the terms of the Agreement.
The Agreement, including the terms and conditions referenced in the signed invoiced, constitues the entire Agreement between the parties on the matter contained herein. The agreement may be amended only as mutually agreed upon in writing.
The Agreement shall be enforced by law in the Commonwealth of Pennsylvania.
